Delaware Dog Bite Laws

Delaware’s dog bite statute, 16 Delaware Code § 3053F, imposes strict liability upon dog owners. This means that the owner can be held strictly liable for any injuries or losses inflicted upon person or property that were caused by the dog. The bite victim would not be required to prove that the owner was negligent, or that the owner had prior knowledge that the dog could be dangerous. A few exceptions shield owners from liability if, at the time of the bite, the victim was (1) committing or attempting to commit a trespass upon the owner’s property; (2) committing or attempting to commit a crime against any person; or (3) teasing, tormenting, or abusing the dog.
