Ohio’s dog bite statute, Ohio Rev. Code § 955.28, imposes strict liability upon dog owners. This means that an owner can be held strictly liable for injuries that their dog causes to another person who was in a place where they had a lawful right to be at the time. The statute also specifically states that the owner will be held strictly liable if the victim was on the owner’s property conducting door-to-door sales or other solicitations.There are three exceptions under which the owner would not be held liable. This includes situations where, at the time of the attack, the victim: (1) was provoking the dog on the owner’s property; (2) was committing or attempting to commit a criminal trespass or other crime on the owner’s property; or (3) was committing or attempting to commit a crime against any person.
