There is no specific number of times a dog must bite before it is mandated to be euthanized. Several factors are considered to make that decision. This means that euthanasia is not an automatic punishment for biting. However, if a dog is classified as vicious, authorities can issue an order for euthanasia. 

The owner does have options. They can challenge the decision, but they must file an appeal within 15 working days. If an appeal is filed, the euthanasia order is paused while the legal process plays out. If no appeal is submitted, the dog may be put down.

Generally, the financial burden of these cases falls on the owner. They must pay for all expenses linked to the dog’s confinement, including veterinary exams, microchipping, and any fines that come with the process. Illinois takes public safety seriously, but it also gives owners a chance to challenge decisions and prevent extreme outcomes if the circumstances allow it.

What Illinois Considers a “Dangerous Dog”

Illinois law defines a dangerous dog as one that threatens to seriously harm a person or another animal without a valid reason. Keep in mind that the focus is on the dog’s actions, not its breed. 

Owners of dangerous dogs may be required to pay a public safety fine deposited in the local animal control fund and take additional steps to keep the animal under control. Dangerous dogs in Illinois may need to get the animal spayed or neutered to comply with state regulations. The dog may not be allowed to roam freely. When outside, it must be in an enclosure or restrained with a leash and muzzle. In some cases, the owner may also be required to enroll their pet in behavior training.

If a dog is deemed dangerous multiple times or causes a serious dog bite injury or death without justification, it may be upgraded to vicious dog status. This label carries much stricter consequences, and the possibility of euthanasia becomes more likely if the owner does not fight the ruling. However, not all dogs fall under these rules. Certain exemptions exist. Law enforcement and military dogs are generally not labeled as dangerous or vicious if an attack happens while they are performing their official duties.
